These terms and conditions of sale are the terms and conditions on which we supply any of the products listed on our website, www.bambiniandme.com, to you. Please read these terms and conditions carefully before ordering any products from our site. You should understand that by ordering any of our products you agree to be bound by these terms and conditions.

We reserve the right to make changes to these terms and conditions of sale at any time by publishing a new version of the terms and conditions on our website. Our applicable terms and conditions of sale are those published on this web page at the time you place your order.

1.1 We own and operate the retail website www.bambiniandme.com (“Website”). Any reference in these terms and conditions to “Bambini & Me”, “we”, “us” or “our” is a reference to Bambini & Me Limited, a company registered in England and Wales under company number 9491171 and its registered office at 21 East Street, Bromley, Kent, BR1 1QE. Our VAT number is GB216 0464 38.

1.2 Through this Website Bambini & Me makes available to you various textile products, babycare products and accessories made by or on behalf of Bambini & Me and our commercial partners (the “Products”) to online web users (“Customer”, “you” or “your”). For the purposes of these terms and conditions, the Customer and Bambini & Me will be collectively referred to as “Parties”.

2.1 Products are sold to private individuals for the Customer’s personal and not professional use. Bambini & Me reserve the right to cancel any order which in its opinion is excessive or not for personal use.

2.2 The Website is only intended for use by people resident in the United Kingdom (including Northern Ireland but excluding Jersey, Guernsey and the Isle of Man) (“Territory”). We do not accept orders from individuals outside the Territory.

3.1 Only the Products currently displayed on the Website are offered for sale (subject to stock availability).

3.2 Photographs of Products on the Website are for indicative purposes only and shall not be relied on by the Customer in any way. The Customer is required to read the description of each Product to be aware of specific details relating to the Product.

3.3 Items “Point Blue” : List of items excluded from all permanent promotions Bambini & Me.

4.1 All prices are displayed in pounds sterling and are inclusive of UK VAT (where applicable).

4.2 The price of the Products and our delivery charges will be as quoted on the Website at the time of placing an order, except in cases of obvious error.

4.3 The flat-rate delivery charge will be added at order summary stage prior to the Customer clicking on the submit order button.

5.1 You may place an order by selecting the Product and clicking on the “Add to basket” button.

5.2 You may do the following at any time:

a) check the number of Products in the basket and get detailed info on each Product by clicking on the “My basket” button

b) continue adding Products by clicking on “Continue shopping” button

c) complete the order by clicking on the “Submit basket” button.

5.3 All new Customers are required to complete the necessary fields to create a Customer account. You must complete the required form which will include key information to identify yourself, a valid email address and password of choice (personal and confidential to you), all of which will serve to confirm your identity on the Website in the future.

5.4 All Customers with an account will be required to confirm their identity after clicking on the “Order” button by confirming their email address and password. Any order placed using your email address and password will be deemed to have been made by you and you will be responsible for any such order made. We therefore recommend keeping such email address and password private and confidential at all times.

5.5 You acknowledge and agree to providing the information requested to us for the purposes of:

a) proving your identity

b) to process and deliver your order

c) Invoicing you for the order

The information you provide to us will remain confidential and kept and used in accordance with our Privacy Policy.
5.6 You are required to double check your order is correct and that all required information has been entered as appropriate, including:

a) invoice address

b) delivery address

c) order summary (type, quantity and price of Products)

d) total cost of the order minus option/s

e) a gift option (Products gift-boxed)

f) delivery costs

g) an “offer” option. To redeem an offer you must add the appropriate offer code where indicated on the order summary page.

5.7 To progress onto the next stage (choice of payment method), you must tick the box confirming that you have read and accepted these terms and conditions of sale.

5.8 Once you have double-checked your order summary, you need to click on the “confirm and proceed to payment” button to confirm the order.

5.9 By submitting an order summary you confirm and agree to be bound by these terms and conditions of sale and the information set out in the order summary. Your order constitutes an offer to buy a Product from Bambini & Me and will be subject to acceptance by Bambini & Me in accordance with condition 7 below.

5.10 Bambini & Me reserves the right to refuse an order if:

a) it considers the order to be excessive or not for personal use as described in condition 2 above

b) there is any ongoing dispute/s with the Customer

c) there has been total or partial non payment of a previous order placed by the Customer

d) the bank has declined the bank card payment submitted by the Customer

e) in Bambini & Me’s opinion there is any other legitimate reason (including by not limited to the non-availability of the Product/s, the order being abnormal or unusual or any lack of good faith on the part of the Customer).

6.1 The sum due for payment by you is the total amount shown on the order summary that you checked prior to pressing the “Submit” button to validate your order. The price is repeated again once payment has been made in the order summary email sent to you by Bambini & Me.

6.2 We accept the following forms of payment: credit/debit cards: Visa, Mastercard, Maestro, Solo Electron and PayPal

6.3 During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed. Please note that we will collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.

6.4 All card payments are subject to authorisation by your card issuer and your card will not be debited until the order preparation is finalised.

6.5 As part of the preventing fraud, Bambini & Me have added an extra level of security for Visa and MasterCard payments, which protects you from the unauthorized use of your credit card. 3-D Secure technology consists of the programs Verified by Visa and MasterCard SecureCode. This authentification payment system will strength the security with your online purchase.

After you enter your credit card details in our online store, a new window will appear, requesting your personal security code. Your financial institution will authenticate the transaction within seconds, as well as confirm that you are the individual making the purchase.

If you haven’t yet registered with Verified by Visa or MasterCard SecureCode, you’ll need to activate this feature first. You can do this during the payment process, or activate it in advance through the Visa or MasterCard website. Please make sure that you can receive the 3D Secure authentification text message.
After you register, you can use the security code for all your online transactions. More and more online stores are making this extra security code compulsory.

REMINDER, your transaction will be cancelled after 3 authentification failures. In that case please contact your Bank.

7.1 Once the Product is ready for dispatch we will take payment and send you an email summarising the order details and confirming that the Product has been dispatched (“Dispatch Confirmation”)

7.2 The contract between you and Bambini & Me (“Contract”) is formed when we send you the Dispatch Confirmation.

7.3 The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

7.4 You will be notified of the unavailability of any Product on an e-invoice corresponding to the order placed. You will receive this e-invoice via your email address no later than 5 days after despatch of Products.

9.1 Bambini & Me will use reasonable endeavours to ensure that orders are processed within a 48 hour period but we cannot be held responsible for delays due to weather or other circumstances beyond our control. In these cases we will process the order as soon as is reasonably possible.

9.2 Orders placed on the Bambini & Me Website on Friday afternoon, Saturday or Sunday are processed on the following Monday. Orders placed on the Bambini & Me Website on a public holiday that falls on any day other than Friday, Saturday or Sunday will also be processed the following working day.

9.3 Delivery cannot be guaranteed in cases of force majeure as outlined under condition 18 below.

10.1 Products ordered by you are delivered to the delivery address provided and confirmed by you in the order summary. Deliveries will only be made to addresses in the Territory. Delivered goods are accompanied by a delivery note that includes details of handling/delivery charges. You also have the option of having Products delivered to an address other than your home address provided the address is within the Territory.

10.2 Bambini & Me will do its very best to ensure that your order is delivered within a maximum of 8 working days from the day after payment has been made for said order.

10.3 Bambini & Me shall not be liable to you for any delay howsoever caused by persons for which we are not directly responsible for example as a result of any postal delay or strikes.

11.1 The Products will be your responsibility from the time of delivery.

11.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

11.3 When you receive your order, you must check that Products received are in conformance with your order. Bambini & Me’s customer services should be notified of any problems regarding delivery (i.e. missing items, damaged items and damaged packaging etc) within 15 days from receipt of Products.

11.4 You may contact customer services by:

c) telephone at 01732240662, 9am -5pm Monday to Friday. Closed Bank Holidays Xmas day Boxing day and new years day new years eve.

11.5 Subject to any other legal rights you may have, Bambini & Me shall have no liability or obligation to you in respect of any complaint made after 15 days from delivery of the Products.

11.6 Bambini & Me reserves the right to ask you to return any Product that you claim does not correspond to your order or which has been damaged.

12.1 You have the legal right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order without a reason. To cancel your order you must give Bambini & Me’s customer services team written notice that you wish to cancel the order no later than seven (7) working days from the date you received the Product(s).

12.2 Bambini & Me will refund to you the total cost of the Products within thirty (30) days from the date it receives your cancellation notice, less any cost of returning the Products, which remains the responsibility of the Customer.

12.3 You are under a duty to take reasonable care of the Products. You must return the Product(s) (using appropriate and suitable packaging to protect the Products during delivery) at your own expense to Bambini & Me Customer Services Department, Bambini and Me ltd, Unit 4a, st Julians, Sevenoaks, Kent. TN15 0RX.

12.4 Your right to cancel your order in accordance with this condition 12 does not apply to certain Products including but not limited to made to measure Products and personalised Products.

13.1 We warrant that any Product purchased from us through the Website will, on delivery, conform in all material respects with its description, be of satisfactory quality and be reasonably fit for all the purposes for which the Product is commonly supplied. Please note that we cannot and do not make any warranty and hereby exclude any liability in connection with the use of the Product in connection with any unusual or non-recommended use of the Product.

13.2 You have certain rights as a consumer, including legal rights relating to faulty or mis-described goods. Nothing in these terms and conditions of sale will affect these legal rights. If you would like information about your legal rights you should contact your local authority trading standards department or citizens’ advice bureau.

14.1 In-store exchanges

You may, within fourteen days of receipt of the Products, go to a Bambini & Me boutique to exchange a Product. Only Products that are unworn, unwashed and in their original packaging can be considered suitable for exchange. An exchange will require the presentation of the appropriate delivery slip or invoice.

14.2 Refunds via the Website

You have fourteen (14) days to return, at your cost, any Product(s) which you have ordered if you are not satisfied with the Product/s. The 14 day time limit starts on the day the Products were delivered to the delivery address. Product/s must be returned in their original condition and packaging and must be unworn, unwashed to the following address: Bambini & Me Customer Services Department – Bambini and Me ltd, Unit 4a, st Julians, Sevenoaks, Kent. TN15 0RX. accompanied by a return slip (available for information purposes and to print from the Website under My Orders) or the return ticket number (attributed by our Website under My Orders).

Should the above conditions be complied with, Bambini & Me agrees to refund the Customer at the earliest opportunity.
You acknowledge and agree that some Products including made to order Products and personalised Products cannot be exchanged or refunded.

If you buy a set of products as a pack (pack of underwear, newborn gift set…), only the complete set of items will be possible to exchange or refund. The pack cannot be divided. An exchange or return of one or several products of the set will be refused.

Requesting return number and form both of these must be included with the returned item.


15.1 Your personal information you provide to us or that we obtain about you through your use of the Website is used by Bambini & Me to optimise your shopping experience with us and shall be processed by us in accordance with our Privacy Policy.

15.2 We respect your right to privacy and will only process personal data you provide to us in accordance with the Data Protection Act 1998, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and other applicable privacy laws.

16.1 Bambini & Me is not liable for any delay or non performance of its contractual obligations relating to our Contract with you if such failure or delay results from any circumstance or event beyond Bambini & Me’s reasonable control (a Force Majeure Event) including but not limited to:

a) a total or partial disruption or strike affecting, in particular, the postal services or means of transport and/or communication

b) any default of our suppliers or sub-contractors

c) fire, explosion or other catastrophes

d) any denial of use of any railway, motorway, port, airport or other means of transport for any reason

e) breakdown of plant machinery, computers or vehicles

f) war, threat of war, armed conflicts, rebellion, sabotage or riots, acts of terrorism and actions by civil or military authorities resulting from such acts, civil commotion

g) extreme adverse weather conditions including flood, earthquake, snow, windstorm or other natural disasters or acts of God.

16.2 Bambini & Me will notify you in the event of a Force Majeure Event within 5 working days of its occurrence and shall be relieved of its obligations to you until the applicable Force Majeure Event is over.

16.3 If the Force Majeure Event affecting Bambini & Me continues for over thirty (30) days, both Parties shall be excused from their contractual obligations towards each other and where appropriate Bambini & Me will refund you at the earliest opportunity.

All services provided to you by Bambini & Me are subject to these terms and conditions together with any previous written or oral representations given or made by Bambini & Me or any representatives of Bambini & Me. Neither Bambini & Me nor you may alter the terms of this agreement without the consent of the other.

18.1 Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.

18.2 Any dispute or claim arising out of or in connection with a Contract or its subject matter or formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales

Bambini & Me has taken every precaution to ensure the reliability of the information and security for Users accessing our Website www.bambinandme.com.

However Bambini & Me cannot under any circumstances guarantee the total absence of errors or omissions in content, technical deficiencies of any kind and of any other factors adversely affecting the correct functioning of the Website.

Similarly, access to the Website and/or its Contents does not imply any kind of guarantee with regard to the aptness of the Website and/or its Contents for personal or specific use by Users.

Bambini & Me cannot be held liable for any damages that may be derived by the use of its Website and is in no case responsible for information held in other sites that may be linked to this Website by hypertext link or by any other means whatsoever.

The User recognises without limitation that all brands, logos, graphics/designs, models and more generally all distinctive elements (text/images/symbols etc) on the Website www.bambiniandme.com belong exclusively to Bambini & Me.

Bambini & Me will therefore issue infringement of copyright proceedings against any person or persons who directly or indirectly contravene its rights.

Bambini & Me also makes it clear that the Website is protected and as such Bambini & Me is the copyright proprietor for every page on its Website, tree menu and all elements therein (photographs, text etc). In that capacity may we remind Users that it is strictly forbidden to use or reproduce any aspect of the Website.
